Terms and Conditions

These terms apply when you download, access, or use the MotoFit app or website.

Important: Motocross is dangerous. MotoFit records fitness and ride data. It is not safety equipment, medical advice, emergency equipment, or an official timing system.

1. Provider and acceptance

Jason van den Berg provides MotoFit. In these terms, “MotoFit,” “we,” and “us” refer to Jason van den Berg.

By using MotoFit, you agree to these terms and the Privacy Policy. If you do not agree, do not use MotoFit.

You must be at least 13 years old to use MotoFit. If local law requires parental consent, you must have that consent.

2. Limited licence

We give you a personal, limited, revocable, non-exclusive, and non-transferable licence to use MotoFit for lawful personal purposes. You must follow these terms and applicable law.

You must not copy, sell, rent, distribute, reverse engineer, interfere with, or create derivative works from MotoFit, except where law allows it.

3. Motocross and activity risk

Motocross and related riding can cause serious injury, death, and property damage. Conditions can change without notice. You accept the risks of your activity and remain responsible for your decisions.

4. Health information

MotoFit can display heart rate, calories, workout effort, and related information. This information is for general fitness purposes only. It is not medical advice, diagnosis, treatment, or monitoring.

Do not use MotoFit to make a medical or emergency decision. Consult a qualified healthcare professional about your health, symptoms, or ability to ride. Stop the activity and seek suitable help if you feel unwell or unsafe.

5. Telemetry and timing limits

Routes, speed, distance, lap crossings, lap times, heart rate, calories, track detection, and other results are estimates. Results can be incomplete, delayed, or wrong because of sensor limits, signal loss, device position, battery state, settings, environmental conditions, or software faults.

MotoFit is not an official competition timing system. Do not rely on MotoFit where an exact result is required for safety, rules, scoring, or a legal purpose.

6. Your data and permissions

You are responsible for the data and settings on your device. MotoFit needs certain permissions, such as HealthKit, location, and notifications, for some features. Features can stop working if you remove a permission.

You must have the right to add a track name or other content to MotoFit. Do not add unlawful, harmful, or infringing content.

Our Privacy Policy explains how MotoFit handles workout, health, location, CloudKit sync, analytics, and diagnostic data.

7. Devices, connectivity, and charges

Some MotoFit functions work without a network connection. Sync, analytics, diagnostics, website access, and some Apple services can require an internet connection. Your mobile or internet provider can charge you for data use or roaming.

You are responsible for a compatible device, current system software, sufficient battery, network access, and secure access to your device and Apple account.

8. Apple terms and services

If you get MotoFit through Apple's App Store, your use is also subject to the Apple Standard End User License Agreement and applicable App Store terms. Apple Health, HealthKit, iCloud, CloudKit, location services, and other Apple services are subject to Apple's terms and availability.

9. Intellectual property

MotoFit and its software, design, text, graphics, logos, and other original content are owned by Jason van den Berg or licensed to him. Intellectual property law protects these materials. These terms do not transfer ownership to you.

10. Changes and availability

We can add, change, suspend, or remove a MotoFit feature. We can also release updates that you must install to continue to use a feature. We do not promise that MotoFit will always be available, error-free, or compatible with every device or operating system version.

11. Termination

You can stop using MotoFit at any time. We can suspend or end your licence if you breach these terms, misuse MotoFit, create a security or legal risk, or if we stop providing MotoFit. When the licence ends, you must stop using MotoFit and delete it if required.

Terms about risk, intellectual property, disclaimers, liability, and governing law remain effective after termination.

12. Disclaimers

To the maximum extent allowed by law, MotoFit is provided “as is” and “as available.” We do not give an express or implied warranty about availability, accuracy, fitness for a purpose, safety, or non-infringement.

Nothing in these terms excludes a warranty or consumer right that applicable law does not permit us to exclude.

13. Limitation of liability

To the maximum extent allowed by law, Jason van den Berg is not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, profit, opportunity, goodwill, or use that results from MotoFit.

We do not limit liability where law does not permit a limit. Your legal rights can differ by country.

14. Governing law

The laws of South Africa govern these terms, without regard to conflict-of-law rules. Courts with jurisdiction in South Africa can hear a dispute, except where mandatory consumer law gives you another right.

15. Changes to these terms

We can update these terms when MotoFit, its services, or legal duties change. We will publish the new terms on this page and change the effective date. If you continue to use MotoFit after the new terms take effect, you accept them.
